I was terminated for exceeding companies 4 point policy but the staff in the HR office did not comply with the termination process as it should have been but instead over looked my termination, the policy, and their own procedure. In the end decided to follow the policy in a timely matter that was in the best of their conveniences and even though I worked an 8 hour shift and was called to the HR office to be told they had to let me go say and write on the write "QUIT" because in their words "IT'S TECHNICALLY CONSIDERED AS A QUIT"

File for unemployment compensation ASAP.

That they say "quit" doesn't necessarily mean they'll get away with it.

If the question is, do I have any legal recourse, the answer is, no, you do not. File for unemployment and look for a new job. Nothing you have posted suggests any illegality.

If that is not your question, please clarify.

Can the company use the policy they please

The day I missed I exceeded my 4 points even though I didn't realize how many points I had prior to missing I understand that my termination was due for me exceeding. What I don't understand is if the HR had received my write up and new that I had exceeded my points why did they not terminate me instead they just left my number in the computer clock in and still let me keep my job and when I asked them why did they allow me to keep my job or why didn't they follow threw with the termination in the morning knowing I wasn't suppose to be there any longer bug instead decided to let me keep my job but then turned around and still fired me. When I asked these questions the only answer I got after 8 hrs of working was "we didn't know you where here today"
My question about this is can they ignore the company policy by over looking the employee termination and then decided to proceed with the termination. The 4 point policy states that once you exceed 4 points it is an automatic termination it is not exceed 4 points still allowed to keep your job then at the end of the day be terminated. If a company has a policy shouldn't the employee's from the HR obied by it just as much as a regular employee

Yes, they can. They can disregard policy altogether; they can follow it to the letter, or anything in between.

If you are looking for the fact that you were not termed immediately to mean that they can't term you at all, sorry but it doesn't work that way. They're not required to drop everything else they're doing and fire you the first minute - they're allowed to prioritize what they have to do and get their paperwork in order and allow you to keep working while they do it.

Sorry. Still no case.
