In trying to fix my fiances debt problems I think I just helped out the debt collector. Before, I found this site, he recieved a letter from the Westmoreland Agency...A Capitol One Co. They purchased a charge off account from Citifinancial Corp with a charge off date of Oct. 16, 1995.

If he sent them $20.00 he could pay off the debt for a settlement of $197.80. Wow what a deal right. So we sent them the $20.

Now , I see that He could have mailed them a SOL letter and been done with them but my fear is that now they will try and collect the entire debt. By sending the twenty his SOL has started over right. Also, he currently has a Capitol One credit card will it be effected.

*** Possibly. Most states require that the debtor affirm the debt in writing to refresh the SOL.

In fact, Georgia also follows this rule:
"9-3-110.
A new promise, in order to renew a right of action already barred or to constitute a point from which the limitation shall commence running on a right of action not yet barred, shall be in writing, either in the party's own handwriting or subscribed by him or someone authorized by him."

However, some states accept a written check payment as affirmation. I believe that Georgia is one of them.
