It was not the war of northern aggression, it was a spanking for our backwards bretheren of the south and a war against slavery!

OK, it was not really a war against slavery, as any civil war buff knows, but that is still my story, and I am sticking to it.*




* Incidentally, I am a decendant of a union officer of Sherman, who was involved with the burning and pillaging of parts of the south, most notably Georgia.

Issue Resolved

Thank you all for your comments. I guess that I will just have to sit it out (begrudgingly).

I also failed to mention that in the beginning he said, " yeah, I will go to court, type up the petition and let me see it."

So I did and he read it and made a few changes and I sent it to the client to be signed, made all of the copies of my claim, highlighted all of the important parts.

That is seven copies, also, each is 37 pages and there is a lot of highlighting involved because I had to highlight each page according to what info. I was pointing out (genealogical).

SO... I have a lot of time invested.

Then, when I was ready to file, he changed his mind.

I say it's a violation of ethics:
FEE SPLITTING
An atty cannot share income with a non-attorney on a % basis.

I have never heard of a California attorney paying his/her staff by commission(except in the Discipline column of California Lawyer & Daily Journal).

If he doesn't pay you, and you sue in small claims, I dread his defense of FEE SPLITTING.

If you are simply waiting for money to escheat to the state and reclaiming it for owners, I believe you can do this as a non-atty.
However, the atty cannot split legal fees, and he is selling his services as legal fees.

That is correct -- the exception being, at least in Ohio, certain profit sharing plans.
