What is the name of your state? texas

if parents have joint custody of a child and one of the parents has not tried to make any contat w/ the child for a long time ( 6 months) can abondenment charges be filed on the absent parent? my step son has been w/ my husband and i for 3 years. his mother has made very few attempts to contact him. he is in a very stabel home, has attended the same school for 3 years. what happens if his mother decides she wants to take him? she does have partial custody but she is also a meth. addict and has no perminit home. can we stop her from taking him?

There are separate issues here. One issue is the Custody/Visitation~ Does Mom have Joint LEGAL custody or Joint PHYSICAL custody? If Mom has Joint Physical Custody & hasn't seen the child in over 6 months, then Dad needs to file to modify the Custody Order to reflect that he is the Custodial Parent. If Mom has Joint Legal Custody with a visitation schedule~ It's her decision whether she chooses to exercise that visitation or not. Visitation is a Right, not an obligation.

If you are asking about Dad filing Abandonment, then check TX state statutes re; abandonment...if 6 months meets the requirements, Dad may be able to file Abandonment or Termination of Parental Rights & then file to allow you to adopt the child. (Usually Abandonment needs to be no support AND no contact - at all- for a period of 6 months to 1 year).

The terms for abandoment in Texas are 1 year with no physical contact or financial support. Both criterion have to be met for abandoment to be considered

you realy do not have to be rude....i am just looking for advice....i am not looking for someone like you to try to put me down for my spelling or capitalization errors..but i guess someone like you doesn't have anything else better to do other than point out other peoples mistakes...i guess that must be the only way you can feel good about your self is to make other peolpe feel bad about them selves..thank you for your sarcasim and if i have misspelled to many words and not capitolized the correct ones i hope it made your day....once again thx for being so shallow...have a nice day...

IF the mother is that bad off, take it to court and prove it, no judge would allow that around a child, if her addiction is nore important she isnt going ot fight you. Just do a modifacation or the existing order
