There are separate issues here. One issue is the Custody/Visitation~ Does Mom have Joint LEGAL custody or Joint PHYSICAL custody? If Mom has Joint Physical Custody & hasn't seen the child in over 6 months, then Dad needs to file to modify the Custody Order to reflect that he is the Custodial Parent. If Mom has Joint Legal Custody with a visitation schedule~ It's her decision whether she chooses to exercise that visitation or not. Visitation is a Right, not an obligation.

If you are asking about Dad filing Abandonment, then check TX state statutes re; abandonment...if 6 months meets the requirements, Dad may be able to file Abandonment or Termination of Parental Rights & then file to allow you to adopt the child. (Usually Abandonment needs to be no support AND no contact - at all- for a period of 6 months to 1 year).
