I am dating an IA, and wanted to know what kind of mess I could be getting into to.........
She has mentioned marriage to me, (which I want no part of) , thats the only way she can become legal. Could I get trapped?

9 years ago when i was a pregnant illegal (overstay) alien in ny they put me on medicaid since i wasn't married. now we are married and have made arrangements with medicaid to pay back the bill. i was told at the time that even tho i wasn't american, the baby i was carrying was, and therefore was entitled to medical benefits. i would imagine it hasn't changed much since then.to make the mother legal you would have to get married but it doesn't affect the babies right as an american if you dont marry but believe me it helps.

Which does not answer the question posed. The fact is, IF the girl, whether or not illegal, becomes pregnant, you can be found to be the father through paternity testing, then you will be as liable for support and the legal responsibilities of the chld as if she were blond, blue-eyed california girl.

The mother's status has no bearing on your legal responsibilities.

if you are a legal who gets an illegal pregnant - your liabilities are still the same - you are liable for child support! Thats it!

In regards to her requests to get married so that she can be legal - if you do not want to marry her, don't ruin both your lives and the life of your child by entering unwillingly into a marriage of convenience! If she has the baby in America, it, for the want of a better word, pretty much Naturalizes her!

Tell her to contact her local immigration lawyer for more details!

As for you - you have a legal and moral obligation to the child!

All points are well taken,....and I thank you all ! I already have two children from a previous marriage, I am looking forward to the day when they are old enough to be on there own. I really dont wont to start the process over again. How do you spell 'vasectomy' !

Too little, too late.

DO absolutely request a paternity test! Do not sign birth certificate or acknowledgement of paternity until DNA testing is done. Do not presume that every pregnant woman is always truthful about who the biodad really is. Look through the archives in the Child Support forum and you will see how very many cases of paternity fraud there are.

well, that's not true. Just because her baby will be born a us citizen, does not change mother's status automatically. Until someone sponsors her for a legal residency, she will be illegal. And her child can do it only after reaching age of 21.
