Im confused.

My husband is in the military and we are currently stationed in germany but will be getting stationed to NY within the next 6 month. My husband is from PA and Im German.

We are trying to have my husband adopt my five year old daughter, her biological father has not paid child support for the past 2.5 years. I tried to get a court order but the state he lives in (Maine) has been giving me trouble since I am German and currently still live over here.

I been reading about adoption for a while now and figured him not supporting his child, gives me a plus point so I stopped trying, he has also not seen my daughter in 4 years. I asked him if he would give up his rights but he wont. My husband and I have been married for 3 years and have another child.

I'd like to know how high the chances are for my husband to adopt my daughter, just about how much we'll have to pay and how long the process would take.

I have also contacted a lawyer before but he wasnt even sure how he can help me. If I wanna get this done i will have to go thru PA right?

I'm assuming the child was born in the US? What state is enforcing the child support order?

Is there an order for custody? Parenting time? What state has that order? What does it say about parenting time?

You said that Dad hasn't seen the child in four years. How long have you been stationed in Germany???

Even if Dad was NOT fighting the adoption, you absolutely need an attorney to help sort out all the ins and outs here. Said adoption WILL be expensive and it can take quite a while, depending on how much Dad fights.

OP is not stationed anywhere, CSO. Seems like one American didn't work out, so she found another.

Sorry - color me cynical.

For termination of dad's rights, you would need a lawyer wherever your existing court orders are from. If he doesn't agree, you are going to have a very hard time.

Once that is done, the adoption would need to happen in Germany I think, since that's where the child is.

I think they are planning to pursue this once they get back stateside.....At least that's the impression I have.

Yeah you are probably right. They would have to establish residency for the child in NY before moving forward with adoption. I don't see it happening if dad objects and wants to re-establish contact with the child especially once she's back in the country and visitation is more feasible.
