I've read several posts on requesting modifications for child support, visitation and filing contempt charges.
All of the above applies to my case and much more needs to be reviewed.
I've been divorced for over 5 yrs and the bottom line is that my ex. fathered a set of twins while going through our divorce. He later married the mother, of whom was fortunate enough to be able to go to school for 3 years while he supported her. Now they both have great jobs, moved 400 miles away, and 5 yrs of every other weekend has changed to not coming to get our son at all. I just recently got a grant to go back to school so money will be tight. He's behind on child support, isn't paying for health care, won't reimburse me for medical bills I've paid, and now it's summer and I intend on him going to summer camp so I can work and go to school. I asked if he could help with some of the camp costs and of course he said no. Meanwhile he's making at least 1,000 dollars more a month than when we went to court, works for the city who we know has insurance, she works, they moved into a house unlike the apartment they had here, and both of his other children are in daycare full-time. I'm fed up! Not jeolous, or looking for revenge, I just simply think that my son's needs should be met just as much if not more than what he does for his other two children.
I can't afford to hire a lawyer, and have been told I can file motions for modifications and contempt without one. Where do I start and where do I get these forms and how do I know which one's I need?
I'm open to any suggestions or advise. Thanks

I have filed all of those you speak about.

I have filed all of those you asked about, pro-se. I have my copies for all of those you speak about, although their are for Iowa, I am not too sure how texas does it, but am more than willing to let you see what and how mine were done, if you'd like.

ok first off, as you have orders in place you have three options, You can find the money to hire a lawyer, you can file a case with the Texas Attorney General's office, they will garnish his wages and order his employer to enroll your son on his health insurance, they are not fast though but they are free because you have a court order from a Texas court which is their responsibility to enforce. You can attempt to go this pro se but be prepared to study up on the law and KNOW what you are fighting for and against. You can bet that he will get an attorney and you will be out of your league.

Your fourth option is to buck up and do it without him. I am sure you are fed up, I am fed up with a lot of things about the family court system. There are a lot of us here that are fed up with the way system works. You can either learn how it works and do the best you can or you can get run over by it.

I personally am going back to school for a law degree, so that I can make some decent money and maybe my husband and I can enjoy the years after the kids are grown in relative comfort. I would like to be able to say that my kids will enjoy the fruits of my labor but they probably won't as I won't be finished with school until after they graduate.

Those are your options as I see it. Either way his new family doesn't matter except that those children with his new wife will give him a 2% reduction on his support for your son. That's 2% per child so it would be a total of 4%. It's actually something 4.17% or something like that but I never can remember the percentages.

Other than that the court doesn't care about his wife, what she makes or doesnt make or anything about those kids. All they care about is that what he makes and isn't paying.

Anyway just my 2c worth.
