I am an Australian citizen living in England.
My husband is British and we have 4 children who have dual Australian/British nationality.
We own our home in the UK and are financially viable.
We would like to buy a house in the USA for the children and I to live in for up to 8 months of each year.
The children would need to attend school but we would probably put them in the private school sector.
My husband would come to visit us at regular intervals and we would all spend Christmas and Easter in the USA, together.
For the remaining 4 months of the year the children and I would be at our home in England with my husband.
I do not like living in England and as we have many friends in the US it seems a viable alternative. As my husband is very committed to his career he needs to work in the UK. For him to commute to and from Australia would not be practicable due to the distance and time involved. However the United States is much closer and easily accessible. He also travels to the US often for business.
Is there a category we could apply for under US Immigration laws?
What is the likelihood of success?

Sorry to tell you that there is no way to achieve what you are asking. Your best hope is for your husband to be sponsored by a US company on a H1 visa and to live and work in the US. He would then be able to bring you and the children across.. but, it means giving up everything to move completely to the US.

I do not blame you though.. The UK is currently not a place I would want to be.. high taxes, another crap govenment and being forced into Europe with the people having no say on the matter.. oh well..
