Ok, everyone. My husband and I ended our marriage with a stipulated agreement with an agreed upon amount for child support and alimony. Ok, he has recently filed an OSC to have both lowered and I just found out that he had lied to me for over 3 years concerning the monthly amount he was getting from his private insurance company. I used the amount he verbally told me he was getting to come to an agreement on support. Here's my question:
Can I file a motion for the judge to impose and award me monetary sanctions against him because he lied, meaning he failed to disclose his true and complete assets and monthly income when we were negotiating the stipulation? We did not have a trial, again it was a marital stipulation. I do not believe the ex filed a income and expense declaration back then, but here is my proof: The ex helped me to get an apartment and we used his income as I was unemployed at the time. In an effort to continue to lie to me about his income, I'm sure he sent the leasing office altered payment stubs from his disability checks. In this new OSC he just filed, he stated his income from disability to be a certain amount, higher than he told me from the beginning, and he stated the month and year the disability company started paying him. That means that if I get the altered stubs from our rental file at the apartment complex, that is proof he lied to me because he had been getting the higher amount all along. Is this enough proof for the judge to order sanctions?? If so, can I ask the judge to order the ex to pay the sanctions in full within the year? Thanks.
