Incorrect/False Alegations

If someone files a false report with DSS...I mean the incedent never happend and that can be proved because I wasn't even living on the property when they said the incident occured and its clear they did this out of retaliation and revenge.

Can a lawyer find out the name of the person who filed the report with DSS to help in an ongoing lawsuit?

There has been allegation of physical abuse and neglect of my son and neglect of my daughter by me, the biological mother.

After speaking with the social worker it is clear that the report was filed fraudulantly. I say this because the report states it happened during the month of October at an apartment that I haven't lived in since September.

It is assumed and seems pretty clear to my family that this was made by the landlord who has been harrassing us for sometime. There is a lawsuit at this time between him and I.

My question is if a lawyer is able to get the report and the name of the person who filed the report? If it was the landlord it would aid in my case that is all ready pending. Also do you know if DSS (department of social services) would go after him for intentially filing a faulse report?

Yes you can get this information from CPS. CPS has the discretion to reveal who the reporter is if they feel the reporter is trying to harm the family. Have you tried to ask DSS yourself for this information? If they know for sure this person deliberately made a false report they might give this information. They are only to remain confidential to those who report in good faith even if the information was inaccurate.

The caseworker said the case should be wrapped up by today so now i'm just waiting to hear from her. When I do I will speak with her about getting the information.

I spoke with the case worker this morning and she said all of the allegations were unsupported. she also said that they can not go after anyone for false allegations. She said that she is not sure if a lawyer can get the name of the person who made the accusations, but she is sure that a judge would be able to.
