What is the name of your state (only U.S. law)? Maryland.

One of my assistants might be indicted, on a somewhat minor charge. Since, she lives out of state, but close enough to travel, will they arrest her, or will they just send a summons to appear?

She says she's innocent & it was all a misunderstanding. So, I'm hoping the arrest isn't necessary. Her lawyer is confident that the charges will be dropped anyway, by the arraignment or lastly, the trail, if there is one. She's such a goodhearted person, I just want to make sure things go ok, and her innocence is proved..

Without knowing the nature of the charges, the specifics of the case, and the wishes of the local police and prosecutor, no one can say whether she will be arrested on a warrant or issued a summons.

She should probably engage an attorney immediately.

I believe it has something to do, with possession of marijuana. She was driving with somebody, & got pulled over for a routine traffice stop. The cop apparently smelled the weed, and found some on the passenger. She's not a drug user, and she says she didn't know it was there. But she was still charged..

I'm not butting in, I'm merely asking for the both of us. Her lawyer said it can go either way... and since she's my assistant, I'd hate to have her arrested. She's a very good friend of mine. Especially because she didn't even know the weed was present.

I came here to ask, if anybody has any personal experiance of them arresting or just summoning.... She doesn't have her own computer, haha, so she asked me to findout for her. There is nothing wrong with being a good friend and boss....

If the officer could smell the marijuana, so could your friend. Yes, you want to see her in the best light and that is understandable. But, understand she is also telling you the story in the way that presents her in the best possible light to you as well.

At this point, no one can tell you whether she will or will not be arrested. If she was already arrested then I see no reason for them to arrest her again unless they have discovered some more serious offenses. She will be told when to show in court and if she fails to show THEN a warrant for her arrest will likely issue.

Apparently, she just thought it was a skunk, haha.

I do see her in good light, because I know she didn't know. She's doesn't like drugs. In fact, I'd go as far to say as she hates them.
Personally, I don't care, if people smoke pot, or whatever, as long as they don't hurt others. Its their business, but she's the type that is, well, judt against drugs completely. She'd be a good speaker for DARE programs, haha.
The only reason I had to give her the test, is because I had to, business wise. My boss told me I had to. But I do trust her...
Could the clean test be used for her, if she goes on trial? Apparently, the weed was a personal amount, for the person... so atleast its not some incredibly large weight.
I feel bad for the girl, and just want to help her, you know?

Blue meanie, (i see where the name comes from?) if you were in my postion, im sure any kindhearted person would want to help their friend, & colleague, as well.... in this difficult situation, sarcasm isn't needed though, you know? :/ but ill be damned if i can't help her, emotionally& help her out, when she's visably upset. Even though she shouldn't be... i just know they'll be dropped. But, im still gonna be there for her, for having to go through this. Attorneys aren't cheap, & neither of us, make bank... (were photographers) i never asked about how i could help her emotionally, just wanted to know if an arrest is possible, since this is obviously a LEGAL site. I thought, why not, Im sure they'd know. Somebody did, thankfullly:)

It is a legal site. LEGALLY there is nothing you can do except help the assistant with counsel.

On "them?" That could be a problem.

If your friend was in possession of the marijuana or it was in a common area of the car, she will have a tough time making a case that she did not know about it.
