Indidana - My ex in Texas has custody of my son and yet once again she has dropped off the face of the earth. Everytime I have to hire a private eye and pay out the ying yang just to get contact back. I have no back child support. I cover all medical insurance and bills. I pay more than whats required including clothes for winter and each school year. I only get to se him over the summer because we live in different states and I can't afford multiple trips after all the other expenses. She has been living in a shelter for over three years and hasn't held a steady job in years.

I've reached my wits end. He's 10 now and he's reaching very critical years. There's got to be a way to fix this serious problem.

Well.... what does your court order say about her providing you with contact info? Let's start there.

It's the standard stuff. Must provide details when you move, etc. The problem is that once again her cell phonew has been disconnected and the mission isn't obligated to connect me to her room.

STEALTH!!! WHERE HAVE YOU BEEN? We need to chit chat!! And it seems to me that she has contempted the court more than once. Seems to me you got a good case for custody. What are the details of your court order. We may be able to point you i9n the right direction if we know what the order says.

File a petition in the state the order was originally written. You need to get proof she is living in a shelter. You need to try to get an order for Temp Custody until she can be brought in for a hearing. I would believe this would be a way to go, but get a second opinion, either from stealth, casa, or BB

Then you file against her for contempt. Your money would be better spent on an attorney.

sirxamiel - been around, getting my parents back from JFK (what fun!) and pissing people here off (more fun!). ;)

My concern is being in Indiana and they are in Texas. What can I do from here in order to make this happen? Attorneys want at least $5000 retainer from what I've checked out.

Go to the state that issued the order. Call child protective services. Get a loan and pay it. If your that concerned with this, then money shouldnt phase you. Its your child, and I wouldnt want my child in a homeless shelter. Id pay the 5000. Your gonna have to sacrifice.
