I don't think IAAL started out in a good mood. IAAL was all over me this morning!!! HA! HA!

My response:

You are so correct.

I was not upset with our writer. He's a good guy, but a little confused with the law, and his sense of right and wrong, and needing to understand that he needed to take personal responsibility for his "ignorance of the law."

In effect, all I was doing was informing him of the law, and giving him a "kindly" kick in the ass - - to shake off that "woe is me" mind-set, and to "see the light" for the future.

Gotta love me.

My response:

Let me see if I can make you feel better about your situation. I live in, and practice law in, California. California is a "Community Property" State, unlike Missouri, which is an "Equitable Distribution" State.

Now, I have been married to Mrs. Liable for 28 years, and throughout those years, we have both amassed great sums of money and property - - with the law practice, the home, the cars, and everything else, well into the millions of dollars. We were dirt poor when we first got married.

Since our vast wealth was accumulated during our marriage, and should it ever come to pass that we would get divorced, Mrs. Liable would basically get 1/2 of everything. Now, call me ignorant, but we never entered into a pre-nuptial agreement, and I am fully prepared to give Mrs. Liable half of everything in that unlikely event.

But, early in our marriage, I discovered the laws, and after going to law school (been practicing now for 22 years), only then did I discover the length and breadth of California marital laws.

That's what I have to lose - - everything will be split, including my law practice which I love, second only to Mrs. Liable.

So, there's always someone worse off, or potentially worse off, than yourself. Count yourself lucky, that it's only a car and $30,000.00. Try millions sometime.

The difference is Mrs. Liable DESERVES EVERY PENNY OF IT for putting up with you all these years... That alone should be a good argument to get her sainted... :D

inheritance

My state is WI..just wanting a clarification. my case is similar. My father died before my marriage..and the inheritance check was actually issued after the marriage, but I put into a savings account in my name only. I did use "some" of this money to pay off hubby's debts (yuk) and downpayment of house. Would this be considered as still comingled money?

Without a written agreement between you and hubby concerning your retention of rights to the money, it wouldn't be considered as "commingling" - - rather, it would be considered as your "gift" to the marital estate.
