AOS=Adjustment of Status=I-485

It is one and the same and you do not separately schedule the interview. The interview is scheduled by USCIS when they are ready to adjudicate your petition. BY that time, the security clearance checks are either completed or not completed and there is not much you can do to expedite it or ensure that they are completed by the time of your interview.

PLease let me know if you have any additional questions.

NYC Security Clearance Timeline?

Its actually comforting to see the advices here (Attny Lana specifically). My receipt date from NYC office was Sep 2002, fingerprinting was on April 2004, July 2004 and interview on Aug 2004. My case is pending approval for security clearance.

I am assuming the right approach is to have my lawyer send CIS inquiry every 3 months or so? I have asked him to send out the first one recently since its been over 6 months.

My concern is too much time passing and the case being re-evaluated with further delays. Is that possible is it just a matter of security clearance coming through?

I see some people listing that they are able to see the status of their fingerprinting (as in USCIS having received the results) in USCIS website. When i check the status of my AOS in USCIS all it says is that a receipt letter was sent out in March 2004. Is there a different way (some people seem to say fax inquiry to FBI)?

FBI Fax?

Majman said:
I filed AOS in November 2001 in Utah. Had interview January 2003 and was told to wait for the name check to be completed and that after that my application would be approved.

I finally received a fax from the FBI last week stating that the name check was completed and that the local immigration authorities had been notified.

The problem is that now the INS says that further checks need to be done. The local Salt Lake City INS office says that the FBI needs more information form them to finish the name check and that the computer system shows that the name check is neither pending nor complete.

I am very very confused. Why on earth can't these people get their stories straight? Has anyone else had a similiar experience where the INS continues to stall after the FBI says the name check is complete?

Could you tell me how you contacted FBI to get a fax confirmation of your fingerprinting? Or point me to where you received that information?

Also i was told its ot just FBI that does security clearance but also CIA and thats what delays the application most of the time.

Thanks.

FBI background checks

I live in Kansas with my husband and I have been waiting for over 3 years now for my status to be adjusted. The reason...... FBI background checks, I was told over a year ago that my case was with the FBI for further background checks and I have just been told that is is still no further along. My husband and myself have contacted our local Congressman in an endeavor to get things moving but we don't hold out much hope. Maybe everyone in the same position as us should contact their Congress representatives and create a large voice of people. We are just very fed up  with the whole thing and are talking about moving to the United Kingdom to live (where I originally came from).

CIS Ombudsman

I just found this on the Department of Homeland Security web-site- "the CIS Ombudsman is dedicated to identifying systematic problems in the immigration benefits process and preparing recommendations for submission to US Citizenship and Immigration Services (USCIS). Ideally, your recommendations for process changes should not only identify the problem you are experiencing, but should also contain a proposed solution that will not only benefit your individual case, but others who may be experiencing the same problem as well. The CIS Ombudsman is dedicated to open and accessible communication with both individuals and employers and not only welcomes, but encourages your comments."

We should all contact them with our problems and prosposals to make things go faster and smoother!

Info on FBI Name Check

I was really looking for information and wasnt really expecting a downer message like this. But, i understand and sympathize with your situation. In my case, i simply followed the advice on following forum: http://boards.immigrationportal.com/showthread.php?t=136848 and it worked for me.

If you havent tried whats listed there, try it. Good Luck.
