my state is FL. I dont know if my question goes here, but i'll ask it anyway. We just found out that my husbands ex has been using his insurance card. She is no longer on the policy he cancelled her off after the divorce, but she has to have a copy for the children. Can charges be brought against ny husband for her using the card? Also what can he legally do to stop her from using it on herself?

If she's not covered, the insurance company will not pay the claim and the health care provider will go after the responsible party (which should be her, as they are divorced and he has no order to cover her, correct?).

So he can not be held responsible in no way. and there is nothing in the papers saying that he had to have coverage on her. he has to keep it on the children. can he take her to court for fraud or just let the insurance company handle it? Also we have to EOB from the Insurance company so we know that she has been using the card. The EOB is saying that my husband owes the doctor money. Thats why we were wandering.

He will probably have to let the claimant know that he is the "responsible party" for the kids ONLY, and that he is divorced and NOT responsible for her debts, and that they will need to contact her regarding any balances for her own care. And that she never had his permission to use the kid's card for herself.

Is the insurance company actually paying on the claim? She might not have been removed and found that out by simply calling. Your husband want to consider putting a password on his account.
If she signed any paperwork at the doctors office with his signature as guaranteeing payment, that’s fraud & forgery. She could be criminally charged…and possibly by the doctor’s office for theft of services too.

No she has been removed because he first thought that the company automaticaly remove her, but he called and found out that he had to show the divorce papers for her to get removed. The company knows that she is not on the policy. the actually EOB says : "these charges were incurred by your spouse after the date of divorce. for this reason, no benefits are available. there is an amount i guess what the doctor charged and it says he owes that amount. She knows she is not on the insurance and hasnt been since 2000. She recently used the card in Feb. and again in March. My husband doesnt want to be held accountable for what she does. So does that mean that she is knownly committing "fruad".
