i became pregnant nine years ago in greece. after returning to florida, and giving birth to my child, my ex-boyfriend (who is a greek and still resides there) decided he wanted nothing to do with our son. i had to go on welfare for 18 months in order to support myself and my child. since then, i have completed my bachelor's degree and have gotten married. my husband now wants to adopt my son. i need to know what i need to do in order to have this done both in the us and in greece. the biological father never signed the birth certificate. in the recent past, he has been abusive and vicious when asked any question regarding our son. i would like to sue him for past child support that he never paid. is that possible? also do i need to have his permission for the adoption even though he has never once contributed to his son's well being (by his own choice). i do not think it is fair that he should be able to walk away so freely from his responsibilities. what are my rights and what steps do i need to take in order to finish this once and for all. please help, i am so frustrated.

The biological father never signed the birth certificate.

Is that possible?

Also do i need to have his permission for the adoption even though he has never once contributed to his son's well being (by his own choice).

I can see why you are frustrated, you are trying to do two things at once, and going nowhere.

Let me ask you this; Do you want to Sue the Father for Support, or, Do you want your husband to adopt the child?

You can't sue and collect support for a child that someone else is going to adopt.

If the bio-dad has never signed the BC, and you have never collected support then you may not have any problems in having your husband adopt the child. NOW, yuo say you were on welfare for 18months, what did you tell them about the father of your child? If your husband adopts the child, you may be forced to repay the amount "loaned" to you by the welfare department.

I strongly suggest you seek legal counsel and figure out what it is you want - your husband adopt the child, or go after the father for support?
