What is the name of your state (only U.S. law)? Texas

My youngest daughter (16) has been invited (last minute due to a family member deciding not to go) to go on a cruise. I am getting a consent to travel form completed and notarized, she already has a passport.

My concern is that her father cannot complete and sign the consent. He is in jail. Not even sure at this time whether he has been transferred from the county facility to the federal facility where he will be serving his sentence.

Since she already has a passport, is it necessary for both parents to sign the consent? I have sole custody, but had issues getting her passport anyway and had to get dad to sign to get it in the first place, but that has been a few years ago.

What else should I send with her to make sure she gets through wherever she needs to with the family she with whom she is traveling?

Oh, and they are leaving on Saturday. Yes, that's right, 2 days from now... But I can't let her miss out on this trip. I can never afford nice trips and this is a really nice chance for her.

I really do hope she gets to go!

With sole LEGAL custody, your consent should be fine...hopefully. Though if you had sole legal you would not have needed Dad's consent to get her passport either.

If it's not there's virtually not a thing you can do in 2 days.

Call the cruise company itself AND the State Dept and see what they say.
 
I know I should have been able to get the passport without his signature, but the clerk I was dealing with in the small town would not even look at the custody agreement. He has never had anything more than supervised visitation with no legal custody at all.

I am going to go ahead and fill out all of the information and make some phone calls...
