What is the name of your state? Florida. I posted in the wrong area the first time and was referred here, hope this is the right area. We own the property, neighbor has a history of odd behavior. Has surveilance cameras pointed at my house and yard. Also high velocity hologen lights aimed at our house, was unable to sit outside on the back deck to even have a smoke or enjoy the evening with company in the evenings. Once he knew we were out there, he would switch them on. We put up 300 foot of 6 foot high privacy fence raised 1 foot off the groung, giving a total height of 7 foot. You cannot see anything over it other than some tall trees and cannot see through it. My husband had our own surveilance system installed to give me piece of mind. The one camera faces the length of the fence line along ours and the neighbors. When we leave the property we set the vcr to record the surveilance. Saturday we played back the tape and caught the neighbor on a ladder looking over the 7 foot fence into our yard, then the ladder appears up against one of his trees and we actually watched him on film set a surveilance camera up in the tree and adjust it so that he can see our house and yard over the 7 foot fence. I am completely creeped out and my husband is about to have a meltdown. That fence cost over $1200 to install for privacy from this guy and I'm at a loss as to what to do. I should NOT have to sell my property for a little bit of privacy.

**A: why would the neighbor do such a thing? What is the complete history on this story?

History

Home Guru, the guy started out as seemingly nice, allways calling us over to the fence to talk. We all live on acreage and are the only 2 neighbors that have property connected in close proximity. We like our privacy and don't go out of our way to gossip about others in the area. We started having some problems on our property, tools and such coming up missing. One night I woke up to a bang sound and walked the house to find the back door wide open, it had been locked. One day he called us over to the fence when we were outside and we asked if had had any problems, he said no, we mentioned the back door and he responded that those doors are easy to open, all you have to do is yank hard and the door will open (mobile home) one day he called me over to the fence to tell me that someone was looking into his wifes office window and that he thought that someone was up on his roof looking down through his skylight. Another time he told me that someone had sabotaged his pump and that someone stole hay from his barn. He was pointing the finger at someone way up the road and said they were propably the same one giving us problems. It got to the point that everytime he saw me outside he would call me over to the fence. My husband got relocated, I was there by myself with my teen. He became a royal pain, I got to the point that when he called at me I would just wave and then go on doing what needed to be done. My husband told me to stay away from him, while he was gone, didn't trust him. One weekend when my husband came home he called us over to the fence, he went into a rant as to why I did not acknowledge him while I was on the mower. He said that he figured that my husband would get mad at me if I waved at him because the neighbor (the one down the road that he was blaming for all the odd happennings) said that my husband told him that he had a "thing for me", my husband laughed at that and said he never said such a thing. After that I completely ignored him. Then he started in on our teen, yelling and jumping up and down grabbing himself. He started calling the law and making reports that someone was doing this and that on his property. He started hanging around the back fenceline staring at my windows. Then he started hiding behind trees. Got him on film hiding and then his reaction after realizeing that I had caught him, a bit later he sits at the back fence with his legs spread apart towards my kitchen window, he sees me filming him at the window, spreads his legs wider and nods down at his crotch, and winks. I showed the tape to a deputy and he said it was definately bizzare behavior but he was on his own property and he was not exposing himself. Found out from a friend in the other direction that a deputy had stopped at her house after taking a another complaint from "the neighbor" and asked her if she had heard anything about him being a paranoid schitzophrenic. She told him what he was doing to me and asked her for my phone #. He called me and I told him everything, he then told me the neighbor had a complaint list a foot long blaming us and gave me the case#. After that while I went into town and came home from the sherriffs dept, my back door was wide open again and the little door on the outside phone jack box was ripped off and the wires pulled out. Also my dog suspiciosly died. Theres more but I think you can get the idea now. We rented out the property. ( I posted about this last year while it was going on) and now we are home and this is what we are currently dealing with. Any suggestions?

Asked the sherrifs dept about the TRO last year and was told that he would have to be caught on my property, following me, or cause bodily harm in order to successfully be granted the TRO. Got the yellow pages out. What type of attorney do I need, civil, real estate, who do I start with?

Interesting advice regarding the TRO. Can a TRO be granted against a neighbor whose legal residence is well within the limits set by a standard TRO? For example, TRO specifies 100 feet radius and if the neighbor's house is within that 100 feet limit, can a TRO be granted and/or enforced?

TRO's come in many forms, not a standard form. No TRO is set in stone, and once in front of the judge, the poster can describe the situation and the judge can order anything he or she wants.

I have no comment on the rest of the OT.

Beside ripping out the door and re placing it with a standard door that is used in a stick built home , and ALSO l moving the grey phone co box to the inside of the house with any wires behind the skirting , you might consider creating a gravestone and on it write NOSY voyeuristic ( bad spell) neighbor and of course re aim your camera to cover the house exterior so you can record when he comes there . of course the headstone might drive him loony or maybe he will stay away thinking you might be even nuttier . also to if you dont have a attorney this neighbor might be the perfect reason to go and establish contact with one .
