Thank you for taking the time to read this post , I will make this as brief as possible. About three months ago my sister began renting a brand new home in a new subdivision here in Phoenix. They have had problems from the day they moved in with their next door neighbor because as they told my sister " we have paid way too much money on our home to have "renters" living next to us." The harrasment she has recieved from them is totally another post all together:cool: , but to hopefully make a long story short it has escalated to where my sister and this neighbor have put restraining orders on each other, and have gone to court where the judge ruled to have both orders remain active.

Here is my question...my sister works for a (non-medical) in home care, where she goes to their home and helps them take care of duties they have difficulty doing on their own. For example, one client she has she arrives in the am and makes her breakfast helps her get dressed, bathed or whatever, does her laundry, helps her go to the bathroom fixes and prepares her dinner and so on. She is not a nurse but has medical knoweledge in caring for these individuals. Her employer is considering possibly terminating her employment because of this deal with her neighbor and the restraining order that was placed on my sister. I do not think they can do this, as this is something that is a personal, private and OFF TIME issue that has nothing to do with her employer at all. There has never been an issue where my sisters job or her performance was affected or ever involved in the harrasment with her neighbor. In fact the only way her employer even found out about this whole deal with the neighbor is that her neighbor somehow found out where my sister worked and her neighbor called my sisters employer "to inform them of the type of employee they have working for them". Like I said that is a whole nother post about the harrasing neighbor.

Can her employer do this? They are apparently meeting with the supervisors today to determine if her employement is going to terminated or not. Any advice would be great , my sister has suffered enough with the "neighbor from hell" I would really hate to see her loose her job over this also.

The sad fact is, yes, her employer can do this. And yes, it does affect her job. Any employee with legal problems directly reflects on the employer.

Would you want someone with a TRO (read into it violence or the appearance of violence) caring for your elderly mother/father/relative?

The company has the right to protect it's assets (it's customers).

Regardless of the tro, in at at-will state, she can be fired for just about any reason that is not protected by anti-discrimination statutes.
