harrisburg, pa. i own my home and a small business. i have lived in my home for 4 years. i do not use the waste company due to owning a dumpster at my business. i recently recieved a bill in the amt. of 500 dollars with a date to be in court from the waste company. the letter stated due to city contract i am bound to pay them whether i use them or not. the trash company had recently changed and i was not made aware by the city or the waste company about the contract. is this legal? does this violate any right?

** why would that be a problem...i pay for the dumpster..i can use it as i wish.. FYI i do recycle, always did. i have a gps that can help me find anything along with recycling plants, lol. the issue isnt where i throw my trash im asking is it lawful to be held to the cities contract. i owned my house before it was entered. and had no prior knowledge until receiving the notice. is a city allowed to enter its reidents into such contract? you obviously do not have any legal background you missed the point.

There was a case similar to this in Atlanta a few years ago regarding waste collection. You may want to read that case or have your attorney read it. It is Monticello, Ltd. v. City of Atlanta, 231 Ga.App. 382, 499 S.E.2d 157 ( Ga.App.,1998).
Perhaps there is a similar case in your state.
