I have a feeling my life is over due to stupidity. I've lived in my house for years without a problem. I receive a rent subsidy because my son got sick 2 years ago and I had to quit my job to stay home with him. I found the subsidy wasn't received in Aug. when I got an eviction notice in Oct. I paid it, and everything was fine. I then learned that part of the subsidy had been paid, and paid the rent in Dec. minus that amount ($245.). Then I got an eviction notice in Jan. Saying I owed over $1,000. I had no receipts, but had signed statements from my landlord saying what I owed for Nov. and Dec., and showing it was paid. I dropped off copies of the statements to her office, with a note saying this clears up the mistake (she always has her books wrong, and we always straighten it out) and that I assumed we didn't need to go to court but to let me know if she didn't agree. We'd cleared up problems like that before. I didn't hear from her, assumed she agreed and now find I have to be out of my apartment in a couple of days. I have no where to go, no friends or family and have a little boy to take care of. I think someone in her office embezzled money, she said the books were all messed up and that she switched to a new system. I can't work, I'm taking care of my son and I can't think. What do I do?

Thank you for the informative link, you're right. That didn't used to be the case. I used to have a good job, ran my own department. I apparently lost my mind since then, having your kid get sick, quitting your job because he can't go to school, then having his father die, now I've made him homeless because I can't function. Your link makes a good epitath, thanks a lot.

I got a notice saying the money they claim I owe has to be paid by Feb. 6 or I have to give my income information for garnishment or I can be arrested. (We live on SSI now). While I was in the shower today, the sheriff put a note on my door that they have legal papers for me to sign and that I am to call them. I assume it's telling me to get out by the 6th.

Sorry, the notice is from the court. I know I'm an idiot, as I Am Always Liable so kindly pointed out. I just pray I still have a chance. Thanks for your help HomeGuru.

WHAT is from the court?

What did the sherrif drop off?

You just dont get it.......YET

There are 2 parts to an ecvition, first they tell you to vacate then when you dont, the serve you papers to appear in COURT... you get a court date to explain it to a judge...

THEN IF YOU LOSE in court..... then a sheriif will toss you to the street....

So lets start this all over again, what exactly did you recieve from the court and the sherrif?

I wasn't clear in my first post. My landlord issued a 5 day notice, I told her I didn't owe any money. This has happend several times over the years, and she always finds her mistake. This time she sent an eviction notice after the first notice. She has also done this before, but stopped the court proceedings when she'd get my receipts/message. I did the same thing this time, left the proof I owed no rent with a message saying I assumed she'd stop it, again, and to let me know if she didn't. That was stupid of me, but she is impossible to contact and the other times she did this I just never heard anymore about it once she had the proof I had paid, she just dropped it. This time there was a court hearing, I wasn't there since I thought it was dropped again and the judgement was entered against me. I have a note from the sheriff to contact them to sign for 'legal papers', with no further explanation.

Then you LOST in court and the sherriff will toss you to the street in a few days.

So start packing fast. You had your chance in court and you blew it by not showing up.

Also they cannot arrest you for not paying a debt, but they might be able to if you refuse to sign the sherriff's papers from the court....(contemp of court.)

This was done ON PURPOSE, so you would miss your court date and be tossed to the street., you just wern't bright enough to realize this until now.

Before you sign anything you need to get some legal counseling. Call legal aid or a tenant's org. Most of the time SSI payments can not be garnished so you want to make sure that you aren't waiving any rights to your protected income.
