What is the name of your state?

My daughter has a 3-year old child with a boy/man she was with for several years. They purchased a car under both of their names which he recently took from the parking lot of her work. (I posted about this under a different forum). While she has filed for support and a custody order, currently neither is standing.

He is a nasty human being and has hit her, had her followed, threatens her with taking away their child, and truly believes he is above reproach. Because he makes a great deal of money, he has her convinced that he will “win” at all costs.

He is a loan officer and makes a very low base pay. The vast majority of his income is paid in commission. He has her convinced that if she files for child support (he is unaware that she has at this point) any amount of child support he will have to pay will be based on his base pay only. In fact, he taunts her about this regularly.

Unfortunately, attorneys in this state are very expensive and I’ve heard the D.A. is lackadaisical about subpoenaing bank records. Is there any truth at all to his statements?

No, there is no truth in his statement that only his base pay will be used for a child support calculation. However your daughter has to make sure that the appropriate parties require him to submit his tax returns for the last couple of years, and not just a W2. Your daughter also needs to make sure that she shows up for every hearing on child support, even if she is told that her presence isn't required.

Thanks for the advice. Since she has already filed the custody/child support papers, can she have that requested appended? He has made it very difficult for her to attend anything since he “removed” her vehicle from her place of employment fairly recently. Read my post entitled “Need Advice – Fast” under Family Law Matters.

This is quickly becoming very ugly – although I doubt any child related custody matters are anything but.

Yes, she can have the request amended. I did give you some other information on the other board. However I will include that the request she intends to make for temporary custody really needs to be made as an emergency request.

SHE REALLY NEEDS AN ATTORNEY.
