Hey all,
my dumb cousin violated his probation. (he was charged with criminal trespass, misdemeanor?) His urine samples came out "dirty" for pot. So he has a violation hearing. Does this mean he is being charged with something new? Is "violation of probation a charge?" ? and he was put on probation for 4 yrs, and this is 1 yr into it? Jail time? if he stays clean till the end hope for expungement? he has a public defender who doesnt tell him anything....thanks for you help in advance!

yes - it's a "charge" in georgia

vop or violation of prob. is definitely a reason to go to jail. criminal trespass in georgia can be either felony or misdmr depending on the seriousness of charge. how many positive screens??

if an offender is on felony probation - and it sounds like your "dumb cousin" is definitely on felony status ; a new charge can definitely send him to jail or even prison. furthermore, if there are more violations in addition to new charge - he is very likely to get jail time.

probation is a privilege; not a right.
