Hello everyone.. I hope to get some much needed advice here.
Most of my block which is about 300 yds long is occupied by what used to be a farm a long time ago--It grows virtually nothing anymore and has branched out to more of a nursery situation where he just buys plants wholesale and resells them.He does grow a lot of flowers..
A farm in my town needs to have at least 10 acres and he meets this criteria by leasing 2+ acres down the road [he usually grows nothing on it]
His latest endeavor is the real problem and it has me very nervous. In a back corner of his property,that happens to be the farthest from his house and closest to mine [my back yard]-15 feet from property line- he has decided to go into the mulch business---you know- the black rotted wood chips that stink--you put it in your plant beds...
I believe his house is either rented or he has the help living there in place of some wages===It would be un rentable if this operation was near it --That is why it is near my house
The operation goes like this---A huge tractor trailer specifically made to deliver this mulch comes every so often,at least once a week,and delivers the stuff. There is a bulldozer that now kicks into action pushing the stuff into these bins that he built for the mulch--the bins are huge blocks of cement stacked one on the other.He then fills landscapers trucks with it---It is a very noisy operation [back up alarm beeps and when he goes to dump the last bit of the bucketfuls it into the truck it sounds like a bomb going off-he jerks the bucket to empty it of every last piece--it also produces offensive--possibly/probably unhealthy odors and diesel exhaust---all blowing my way
The zoning law--he is zoned as a farm which is BS BTW] says that this operation can be open and making noise spewing diesel fumes from 7AM Monday to Friday--8AM to 6 PM on Saturday, and 11 AM on Sunday--If you sleep from midnight to 7 AM you have 3 hrs peace during the week...!!!!!
-This is a fledgling part of his new game plan to make easy cash money and it will only become more busy as time goes by---I am sure he hopes it is non stop since the markup is huge and he makes hundreds of $$$$ for a few minutes work---this will be the most profitable/busiest part of his operation if he has anything to say about it---He is nothing more than a middle man
There is a very unpleasant odor that comes right into my kitchen,family room,dining room, 2 bedroom and the large bathroom upstairs.You cannot leave a window open..The mulch is stored in bins but it is 8 foot over the top and always uncovered and the wind blows over the top into more than 1/2 my house There is also an extremely annoying backup alarm that beeps every time the bulldozer backs up which is a lot because it is not a big area---
When this starts in the morning you are now officially awake for the day your stress level is off the charts and so is your blood pressure---especially when you consider the is is permanent and only going to get worse---it causes a lot of stress and i know it is not helping my blood pressure---never mind the deisel fumes that all blow my way
My main concerns are my health and my property value and what will happen when I sell my house and am showing it and the stench/noise are alive and kicking. I see a big problem and maybe even not being able to sell it at all...
my feeling are that he can do what he want as long as it is within the law and does NOT infringe on my basic human civil rights as a citizen if the USA----
I have a deck, a screened in porch, and a built in swimming pool that may never be used again---My windows need to remain closed or else I have to deal with the smell and noise=srtress=stroke---I am dreading making a barbecue today---It is so stressful hearing the beeping alarm/noise from the bulldozer and then there is the ever present offensive smell---that can only blow in one direction--my way.
He does have some bushes that are a half assed attempt to quiet things down but they do nothing and they are not planter just in a burlap cloth---If someone comes in today and wants them --they are GONE
In summary: does his right to use his land trump my civil rights---I am not saying he cannot do it but there needs to be some protection for property values and quality of life issues... I am not the only one affected but I get all the odors--I have contacted other neighbors and they are not happy but seem less disturbed than me--maybe because they don't get the stench or it has not sunken in that this is permanent..
