Someone please tell me if this is an early April Fools Day joke or am I wrong and just way to full of myself.

Two days ago the team my son plays for got their uniforms in. So, nice as I am, I take two pictures of my son (one front and one back) and sent them via e-mail to his BM. Today she writes me an e-mail asking why his correct last name isn't on his shirt. She is pissed because he is using my last name and she is saying I am trying to alienate him from her and she will get me in court for this.

Is she just blowing smoke?

I don't know how the laws in your state work, so I may be completely off on this. My daughter has my last name... it's what I put on the birth certificate. Her father was not listed on the birth certificate because he was not there to sign. No biggie to me really. When we went to court for CS it was stated that the birth certificate was to be ammended to include his name as the father. He took me to court insisting that it was ruled that she was to take his last name. The judge said that I could have indicated any last name that I chose... his, mine, some made up name, whatever. I'd say don't worry. She sounds manipulative and petty and I wouldn't get worked up. She's one of those people who hasn't got a clue about the law. Much luck sweety!

Yes she is blowing smoke and she's stupid. A judge would rip her a new one for wasting his/her time over a name on a jersey.


Just out of curiosity, does he not carry your last name?

It's hyphenated. She was just going to put her last name as his on the birth certificate even though we were married at the time of conception and birth (she was actually going to put her boyfriends last name and him as the father). I had to beg and plead with her to put my last name on there and then she went and hyphenated it. She knew how important it was to me for him to have my last name because on numerous occasions I had begged her to change hers.



Also she wasn't going to take me to court for just that one reason. She says she is going to bring it up at the custody hearing.

ok.. so your son's legal name is hyphenated? Is that legal name on his school RECORDS? Does he actually hyphenate it when he writes his name on say school work?

Wanna get her goat? Tell her you had to pay PER LETTER for the name... and let's hope her last name was LOOOOOOOOOOOOOOOOOOOONNNNNNNNNNNNNNGGGG and if she wants it changed she can pay for it...plus half the jersey...:D

No. School records, health records, insurance cards and ss card all have my last name only. He doesn't write his name yet even though he knows it. He goes to a special school because he has a significant language delay.

She might be able to get you there.. If his birth certificate has both names then his school records should have both names. As far as if he uses it.. it's up to him... but legally it should be on his school records.

Yes, but she doesn't know about that stuff.

She could really care less what his shirt says she is just trying to find some kind of footing. And what "gets my goat" is that she will NEVER even see him play.

What kind of custody do you have? EIther way she has the right to those school records adn she will find out. Although i feel strongly a child should have a father's name except in extreme circumstances others feel strongly that even though they are women their identity shouldn't be lost with their children.

I have temp sole custody. It would be nice to know that she would want to see his school records or be involved in some way but it's not going to happen.

After the custody hearing I am going to kindly ask her to consent to changing his name, then I will go about doing it legally.
