What is the name of your state? Arizona

my fiancee and i are trying to pick up his daughter on the 23rd....but we have little/no proof that we dropped her off 6 months ago in February (the court order is 6 months to each parent untill school age). all we have is a reciept from that day for an oil change and the reciept from the hotel we stayed in that night when we dropped her off. is this considered proof????? any coments would be appreciated!!

:) From what I understand you say there is a court order. If there is one then you have the right to pick up the child, bring the parenting plan with you. If the child is with the pther parent, then it should be obvious that it is your time. Do you think the other parent will denie you your time? :p

yes there is a dispute......the dispute is that my fiancee's ex wife says that she's not going to let my fiancee have their daughter back and that he has no proof showing when we dropped her off. there is no specific dates said to be "exchange" dates, it was agreed verbally back when we thought she was going to cooperate with us. and also there is only a divorce agreement....no custody papers it just states that the custody of the child shall be shared by both parents 6 months to each until school age, and then come time for school my fiancee is supposed to get her. well, his ex has expressed that she doesnt care about the divorce agreement and says she's going to stop him from having her. help!!!!

Heres afew suggestions that I hope help you. You could take her to court with out a lawyer and file for a modification of the current parenting plan, in the plan state that there are no specific dates for the 6 month here and 6 months there, and also let it be known that the bio mom is denying you visitation, she can be held in contempt of court... Also, during the 6 months that the bio mom has the child, does your hubby get any visitation with his child, if so, when its time for visitation get the child and file for temp. custody right away, get the ball rolling. Bring both receipts and the actual court papers with you. Contact the police for a police escort to the mothers house showing the actual documents that state every 6 months. Basically, the police will not step in and take the child from the mother, but will advise her to do what is best. It will also give your fiance written documentation if she refuses to let the child come back with her father.

Good Luck, be ready for the police not to step in and let the child go with your fiance. But you need to make this trip and document everything including receipts of hotel stays, McDonalds receipts, whatever it takes to show you were there. Believe me it will help.

thanks for all your suggestions. we live in arizona and her mother lives in texas, so during the 6 month period she is with her mother its hard for us to get away from work and all that. however we were calling her twice a week for the first 4 months and then all of the sudden we stopped hearing from them......we called and left numerous messages but they never got returned. so we had to contact her at work after weeks of trying to get the phone number (she's military) and then she kept saying all this crap about her keeping thier daughter and how we have no proof of when we dropped her off and then she said that because she'll have their daughter for 6 months she can claim residency and take us to court for full custody. we are so confused now......the only proof we have is the divorce agreement and the reciepts from february, also we mailed her a registered letter stating the date and time we intended on picking her up.
