The other night my parents, good, law abiding, no criminal past whatsoever people were driving home after a President's Day trip to visit family along with my five sibling ranging in ages from 6ys.- 16 yrs. Everyone had fallen asleep except for my dad who was driving. He was pulled over in Globe, a town infamous for having bored cops, for speeding. My dad stepped out of the vehicle to talk to the officer for two reasons:1) he didn't want to wake my family who had school the next day and 2) for his pride. He always steps out of the vehicle to talk to officers. Well this cop told him to get in the vehicle and my dad said he could stand outside. The officer then proceeded to arrest my dad. My mom stepped out, a woman who is barely 5'4" and 125 lbs. She asked why my dad was being arrested and was told to get into the car. She said no, asked again why my dad was being arrested and was then told that she was arrested. My mom said she wasn't arrested because there was no reason for it when the cop slammed my mom against a cop car three times then arrested her, also. Neither of my parents fought against the cop, they're not the type of people to do so. But my mom was more reluctant than my dad because she didn't want to leave my siblings sitting in a van in a strange town. The clincher to this is that my dad wasn't even the one speeding, it was the guy next to him. The officer admitted this. But my parents were still arrested. Is this right?? What can be done?

Based SOLELY on your description of the incident, your mom and dad were guilty of resisting arrest and failure to obey a lawful order of a law enforcement agent.

The rough stuff by the cop may or may not have been necessary; I am sure the cop has a different version than you.

This is dumb. My parents didn't even resist arrest and there was absolutely NO reason for the violence. This officer also had his 18 yr. old brother-in-law riding along with him that night. Could he have been putting on a show???? Hmmm...... Also, the officer's back up asked the him what "this was all about and what was he doing?" Heard by one of my parents. I know that you have to be told why you are being arrested and the reason my parents were given was "For resisting arrest". Does that make sense? And did my parents and especially siblings have to be put through that?? I don't think so. What kind of view do you think my younger siblings now have of officers? My parents didn't resist arrest, the questioned it and were then arrested. This isn't right. The town the arrest was made in is small so not a lot of action goes on and everybody traveling through there knows to be extra cautious of the laws as the cops will pull someone over for going 3 miles over the speed limit, which is what happened to a close friend of mine. The cops in this town just need to get over themselves and get a life. (By the way, this attitude is seriously frowned upon by my parents, even through this situation. This shows how much they comply with and respect the law.)

Maybe your parents need to watch a few episodes of "Cops". When an officer tells them to get back in the car they should have followed orders. Watch what happens to people on Cops that get out of car and don’t get back in when told to do so. Usually the end up with face full of asphalt.

Hmm... Your friend admitted to you he broke the law, and now you wonder why he was ticketed. Speeding is speeding.

Bottom line... The officer doesn’t know if your dad is a normal person, or a rapist that is jacked up on Angel Dust with a loaded gun trying to kill him.

Yeah, I know he was speeding and that "speeding is speeding". Thanks for pointing that out. I was just using a case where it's obvious these cops are bored. And I'm sure you would feel the same way if you were pulled over for doing 3 over the speed limit so stop being so self-righteous. AND just so you know, I wasn't wondering why he was ticketed. I'm not retarded.

Also, I think that these officers have been watching too many episodes of "Cops". You can tell just by looking at my dad in his button-up shirts with a little bit of belly and his kind face and demeanor that he's not on "Angel Dust". Whatever that is. Or a rapist.

Cops do not like drivers to get out of the car. Period. It's also expected that when a cop tells you to do something, you do it with no questions asked or arguments made. Your parents screwed up on both of those points, and are now paying the consequences.

Criminals are not required to look a certain way.

I had a cop tell me once that if an elderly nun started acting funny, she would get cuffed because the cop was going to go home that night. He was always going to protect himself.
