is wife responsible for cs for husbands illegitmate children

My husband has fathered children during our marriage. We are not divorced . We are and have been seperated but not legally seperated. Now the mother of these children has filed for child support, also asking for $1800 in back support. My husband is unemployed, can I be held responsible for this debt to the mother for his illegitmate children ?

Absolutely not. You have no financial obligation to those children. However if you ALSO have children with your husband, I hope that you already have an order for child support. If not, your children may come in "second".

Also, if you have assets in common (house, car etc.) if he gets far enough behind in child support those assets could be attached......so it probably time for you to file for divorce if for no other reason than to protect assets.

Tax Question about Child Care

I know i've already asked this question, but I did some research and would like to reask if i could, now that i know what i am asking for:

My child support is taken out of my check every week and given to me ex through DHS. My child support before never contributed to her child care expenses, but we have it readjusted so it does now. I pay 110.00 child support 55.00 child care a week for two kids. But it's all combined as one payment. But on the child support worksheet it is broken down.

My question is, the 55.00 that i am putting about for child care, do i do something with that come tax time? I'm not paying the daycare (aka her boyfriend for the time being) the money goes directly to her, and she does with it what she wants really. Feburary though she will have to provide me with proof of what she's paying for child care, i have no idea what she will show me. Can she just write anything down on her taxes of what she paid out? Do i put on my tax return what i'm paying her to pay for daycare, or a babysitter?

Indirectly, YES.

A. Money he has previously used to support his already born kids will be automatically redirected to the CP of the other child. Thus, if you wish your children to be unaffected by the change in funds being used to support them, you will need to make up the difference.

B. If his assets which are jointly held with you are seized or liened for the any "back child support", your interest in that joint asset will be affected.

C. An tax refund for a joint filing might be intercepted if CS is owed but unpaid (filing injured spouse helps protect your share).
