Summary of situation. Ex and I have joint legal custody of children. He had been out of there lives until Nov 2005. Very pleased he is making an effort to be with the children. Still only sees them once a month sometimes twice a month but its better than nothing. Chilren are 11 & 8.
Here is my new situation. He feels the children should be taken out of the school that they are currently in and moved into a new school in a new district that is close to his home because he feels its a "better" school.
The kids go to a specialized school for the hearing impaired and our both fluent in ASL. My 8 year old is HH and needs the FM system and ASL for learning and my 11 needs one of one assistance to help with his LD. The kids have been in the school since Kinder and enjoy it and I am very active in the school. This school also has there younger half brother there and is Pre-k through 8th grade. Currently they are in 3rd and 5th. It is a specialized school but is publically funded so there is no tution or fees.
He is telling me that since we have joint legal custody that he has a leg to stand on and if I do not agree to this change he is going to go to court and ask to have it changed. He hasn't wanted to go to court on anything since he has returned to our city.
My question is should this be something that I should worry about and does he have a leg to stand on?
