Issue with Logistic Company & CBP in Chicago Area

I am an amazon seller based in Vietnam. Recently I had a shipment sent thru my logistic company to the US (Chicago Port, Airfreight). This was not my first shipment and I was ordering to door delivery to an amazon warehouse as usual. The shipment was delivered to amazon on time and without any issues.

One week later, after amazon already processed the shipment and start selling thru the platform, I receive email from my Logistic Company as well as from the CBP that my shipment was not cleared by custom. Apparently my logistic company (at least one staff) removed the cargo from the warehouse and delivered it to the final destination (amazon) without having customs cleared. The person which did the mistake was terminated by the logistic company.

However, the bigger issue now is that I have to sent my cargo back to the logistic company warehouse so that the CBP can undertake it's examination of the cargo and release it officially. As it was sold on amazon and it is a consumable good, I do not have the complete shipment anymore. I already asked amazon to stop / put the product on hold but some items are already sold. Basically, the cargo should have never been removed nor touched by the logistic company until the cargo was officcialy released by customs.

Beside having a lot of trouble, back and forward with amazon / logistic company / CBP this is obviously a very expensive issue (beside being illegal). This could threaten my existence as a business due to fines, penalties, shipping delays, missing sales etc....

Would someone be so kind to help me out with some advice? All help is much appreciated. All paperwork for the shipment are in order, meaning FDA registrations, Hygiene Certification etc....

It's incumbent on you, as the shipper, to make sure your goods meet all the requirements for importation into the United States including whatever USDA, FDA, and authenticity issues there may be. Amazon WILL NOT act as the importer of record or as a customs broker, their responsibility ends at taking the orders for you. Your logistics company may assist you with such approvals so if you have a possible issue it is with them NOT Amazon or the FDA or the CBP. Even if the logistics company helps you with the approvals, it is required that YOU obtaint he the necessary FDA registration.

Thanks for the replay. I understand that Amazon has no responsibilities in this. The main issue here is between me and my logistics company. I sent all documents to them (FDA etc....). The issue is that one staff from the logistic company removed the cargo from the warehouse in the US without having the proper Clearance from Customs and delivered it the amazon. The fault is clearly at the logistics company as they should have never removed the cargo without being cleared and approved by customs.

Now, since I was not aware of this, and amazon received the goods (as many other shipments from me before) I thought that everything is in order and we started selling the product. UNTIL the CBP sent me an email that the cargo was not cleared 100%....

I have to sent back the complete (or at least what's left of it) back to the Logistic Companies Warehouse in the US, to let the CBP clear the customs accordingly. This will have a financial impact on my business and could threaten my existence as a business due to missing sales and fines etc....
