What is the name of your state? CA
A month ago today a girl hit my car. It was totally her fault, and I have a witness that tells the same story that I told. I was going north, I had a clear lane with no stop signs or lights. She was coming out of a parking lot, trying to turn left to go south. As I was coming she started to make her turn. She stopped right infront of me, blocking my lane. I hit my breaks and swerved around her. I had to swerve into the south bound lane so I wouldn't crash into her. As I was going to clear her she started to turn, hitting the right side of my car. I had the right away in a lane that she blocked.
I called her insurence company and reported it. They called my witness and got her story. All the damage showed that she hit me. It was 100% her fault.
The problem is she wouldn't give her side of the story to her own insurence company. She went and got a lawyer, and it took them two weeks to give her statement. The case worker says he can't do anything until he gets her full story, but he's been having problems getting it from her and her lawyer. Now they are trying to claim that I was speeding. The thing they have to do now is inspect her car, which hasn't happened. The case worker said it could take a week or two, because he has to work with her schedule.
My car has been sitting at a body shop for a month because this girl won't give her damn story, and she hasn't gotten her car inspected. What can I do to get this taken care of? The body shop can't start to work on the car until they get the word from her insurence company, but they can't do anything until they can get her to give her full story and get her car inspected. The case worker has pretty much said, without say it, that it's her fault and he's ready to pay out. But his hands are tied because he can't do anything until he gets everything on her side done. But it seems like she's not trying to get anything done. This has all been BS.
