Hello...he is my husband. And yes this does concern me as he has gone through HELL dealing with her and as I am apart of his family, I deal with it also. What kind of wife would look the other way? My question was, why would the judge refuse to give the tax returns back and say the only way he would is if my husband reopened the divorce case??? We know he can call IRS and get copies, but his lawyers secretary said she has never heard of a judge doing this and neither has anyone else we've asked.

Actually, hon... since you're not a party to the case, it really is none of your concern - LEGALLY.

But, because I still have a bit of kindness left in the well today, the tax returns your husband provided to the court have become part of the file. They will remain there. He should be able to get copies of his file (tax returns included), but is not going to get the originals. Why his lawyer's peeps don't know that - is anyone's guess.

a) The parties to a divorce can pull the court file and copy whatever they want from it; and

b) IRS Form 4056 is one click away on the computer.
