NY.

This mostly pertains to my GP case, however I suppose it's general.

When a Family Court Judge says that he is "reserving decision", how long does s/he have to actually render a decision? I "heard" that it was 60 days, but am unsure of the truth of that. I would google guys, but I haven't a clue what words to even plug in:o.

Thanks!

is court date coming up - or has it passed?

Sorry, my original post has been deleted incase the gps found this site. This has been an ongoing case for 2 years () now. The gps were given a temp order for visitation (yes, I know this violates my right to due process and my rights as a parent). When I fought the order I was held in contempt. I filed a modification to clarify the order and was told on July 9th that he was reserving decision and have yet to receive a decision. We have had 2 dates since that time and have 2 more approaching in January.

The Judge may be reserving decision ( what decision is the Judge reserving ? ) , until after further hearing(s) . ??

I filed a modification for the gp to follow certain guidelines wrt the kids. We've had hearings in between and the two in Jan are hopefully to be the last.

were the past 2 court date status/scheduling conferences? what are the upcoming ones?

We've been in trial since March. A couple of the hearings in May/June were for contempt. 2 days of trial in July (which is when we argued my motion to modify and he "reserved decision"), 2 more trial days in October and 2 more coming up in January.

I asked for the visitation to be suspended until the end of trial as per my rights to due process and consitutional rights as a parent or at the very least that certain guidelines be followed to ensure my children's safety. I don't understand WHY I haven't received a decision. I mean if trial finishes in January and he renders a decision, then why did I waste time with a modification?

For informational purposes.....

I was finally able to talk to my attorney and she confirmed that it is 60 days. However, if the judge doesn't render the decision, there isn't much you can do.

can your lawyer send him a politely worded query??? you know to gently remind him that he does have a decision to make
