What is the name of your state?NY
Can you be gainfully employed and still file Ch. 7? The person in question was out of work for an extended period of time and was unable to keep up with bills, had been evicted, left owing apt complex big bucks, finally has a decent job but feels like she's never going to catch up. Has approx $15 to $20k in arrears with creditors threatening judgements and garnishing of salary.
If she were to file for Ch. 7 (no assets except 7 year old honda) is it up to a judge to decide if she can declare or is it automatic. I guess what I mean is how do you find out if you qualify to declare bankruptcy? thanks for any info.

Nothing in the bk code references your employment status for a Chapter 7. There is no qualify for bk. AT least not until bk reform takes affect on 10/17.
Most bk lawyers give free initial consultations. Talk with a couple and see what they say.
