I just went threw court for child support with my ex the lawyer he is using has represented me in the past for a different case. I don't think the lawyer rembers me being that i only used him once along time ago. Can he do that. or is he not suppose to represent him since i used him? I guess it's not a big issue because he's really not that good my attorney is much better i was just wondering

That's not a good thing for a lawyer to do. I do not know if it rises to an ethical violation because you did not give us enough facts.

If the lawyer prepared a will for you, for example, this may not be a conflict if he did not learn anything that he is using in the current lawsuit.

But, if a lawyer has represented an adverse party (you) before, he would be smart to get waivers from everyone involved.

I wouldn't do what this lawyer did...there are just too many smell bads here.
 
the lawyer that is representing me ex in the child support and custody represented me on if i remember right i think it was trespassing it was about 6-7 years ago and I didn't think he did the best job. My attorney now would have done a much better job

He probably can represent your ex if he did not represent you on a divorce matter, or if any confidential information he found out about you then would not hurt you in this current case. But (if he remembers) and you are worried that he did learn things that could hurt you, you probably just need to suggest to him that he "has a conflict since he has previously represented you", and he will probably back out of the case. However, then your ex might get a really good lawyer!
