I know if you are drunk and you get in your car and turn it on you can be arrested for a DUI.

But what if you are sitting in the passenger seat and you turn on the car even though there is no one else that is going to drive your car.

Here in Florida, if you are the only one in the car, you are drunk, and the keys are in the ignition (even if the car is OFF), you are DUI.

In my state, "Operating" is defined as being in a position to be able to manipulate the controls necessary to put the vehicle in motion.

Driver's seat? Definitely.
Standing in the open driver's door? Sure.
Front passenger seat? Probably.
Back seat? Very iffy. Nearly impossible with newer cars that require you to step on the brake before it'll shift out of Park.
