This all takes place in Kansas.
I was living on campus up until the end of last semster when a 'friend' of mine came to me begging me to move off campus with her because she was in fear of her life with her present roommate (also boyfriend). She also said she needed to more 'today'. So I said I would help her out being a nice friend (never going to do that again).
Well we found a place and each of us signed the lease (her name was first then I signe dunder her's). She also told the landlord that she would put her name on all the bills (gas, city, etc) the following days. Well I took off for winter break as planned.
While gone she contacted my mother telling her I needed to put my name on the gas bill now. My mother said that I would not be able to until I got back. She then told my mother that she would need to call and put my name on the bill. My mother called the gas company to see if she could and the company said only I could.
I then recieved an email from my roommate telling me I needed to put my name on the bill. I told her to put her name on it and when I got back I would change it. She told me she would take care of it herself.
When I got back she had already unpacked all her stuff. Everything except for my bedroom and a 6X3 draw in the bathroom was her stuff. So to make it a little like home for me I rearranged some stuff.
When school started back up thing broke out. She yelled at me because I moved her stuff and I better move it back. I told her no. I told her I paid half the rent and I had rights to live in my house. She said no I didn't. I then told her that if it was going to be that way I would pay for use of 2 of the 6 rooms and she could figure out how to pay the rest (lease did not say each had to pay half).
Well then one night while I was gone my roommate went to the landlords. She told them that my cat was peeing all over the house (I had caught her dog doing this), that the beeping was from me doing laundry (which was a load she had done for her boyfriend before she left), and many other things including the fight above.
When I got back she proceed to tell me about this 'meeting' she had. She told me that the landlords said that they wanted me out, but she kept them from kicking me out. She also said that since she was first to sign the lease that she was tenant and I was co-tenant and if need be she could kick me out.
Well I got sick of this and went to my landlord about getting out of the lease. She was okay with it, but wouldn't not be able to give me my deposit back unless I found someone to move in. I told my roommate this and waas giving her 2 weeks to find someone. She proceed to tell me that because of the lease if I left I would have to pay half of the rest of the year (lease said that if the lease was broken that we would have to pay the remaining portion of the year).
Well the day (Saturday) came I was moving out (still had a week before rent was due). I went to get in and my roommate had change the lock on the doors. She showed up and let me in. My mother and I took a load to my new place, do some cleaning and then go to lunch. When I returned to my old apartment all my stuff was tossed out of my bedroom in to a pile in the backroom and some in the driveway.
I went to the landlord to return my keys to find out the day before (Friday) my roommate and a new girl had gone out there and resigned a lease without me. I got $200 of my $250 back. The landlord kept $50 to cover the gas bill that my roommate told her I would. Then a few weeks later I get a gas bill of $200 for that address. My ex roommate had put my name on the gas bill while I was on break.
I have since paid that gas bill to keep from my new place getting shut off. I have told each person I have spoken with at the gas company that I did not put my name on that bill and it was my roommate.
I guess my questions are:
1. Can I do anything about the gas bill? I have no way of proving it wasn't me. She got my SS# from some school paper work I had in my room.
2. Is there such thing as a tenant and co-tenant like she said?
3. Can you change a lease legally like they did?
4. Could my ex roommate change the locks and kick me out like that even though my month wasn't up for another week?
