What is the name of your state (only U.S. law) IL?

Hi,

I am L2 EAD and i will be joining Company A soon and they are ready to file my H1B starting April.

My question is If i get a h1B approved which is effective Oct 2012, Can i transfer my Approved h1b to another company B before Oct 2012?

The earliest the H-1B can become effective is October 2012 so if you want to change employers it would have to be after October 1, 2012, as it is not possible to do so before. A new employer would also have to file a new petition on your behalf since it would not be a transfer if you are not yet in H-1B status. It would not be subject to the cap, however, if the first one is filed in April and is counted in the cap.
