I am in H1B and working for a company since Oct 07. I am not enjoying my job very much and I have started looking for a new job and plan to leave the company by the end of July.

I have told the company I am leaving and I told them that I will come back if they can do my green card and I will work only after I get my GC. I do not have an immigration lawyer and I am trying to figure this thing out myself and I need to help the company on how to advertise etc. I have two masters degrees (one obtained before I started working for the current company and one after). My job title is Operations Research Analyst. My first master's degree is in Public Policy and the second one is in MIS.

I talked to a few people and they told me that I cannot use my second master as it was gained after I started working for the current company and I cannot use the first one as it does not match with the job title. My goal is to be able to file under EB2.

Please give me some advice how I should go about making this happen. Please keep in mind that by the time the company is ready to file my LC, I will not be with them, but the position and their desire to hire me will still be there. Thanks.

To begin with, trying to do this on your own is a big mistake because you are getting way in over your head.

You cannot do this as a EB2 if your degree does not match the position and the second degree was obtained after you were hired by the company who will be petitioning for your labor cert.

I wanted to hire a lawyer, but most of them were too expensive for me to be able to afford and some of them did not seem to know what they are talking about.

At my current company (manufacturing), they are starting a new project and they are in need of a Business/Systems Analyst. That will be a new position and my master's degree that I gained after I started with this company matches what they are looking for and I also have a couple of years of experience (3 years) on that type of job.

I looked at Systems Analyst in O*NET and it looks like it will not be qualified for EB2 category. Do you know if this job title can be qualified for EB2 and if I can use my second master's degree (obtained after I started here) for this job? Thanks.
