landlord changing locks w/o right of posession

My landlord told me she is changing the locks on our house tomorrow. She has not posted the 5 day notice to vacate (although i think waver of notice is in our our lease). she has not filed for eviction. Our rent is due on the 1st with 5 days before she can file for eviction. we paid in full for august.

what can we sue for when she changes the locks? most of our stuff is out but with her being so crazy i am feeling like she has to file for eviction at this point and she really needs a lesson regarding tenant rights.

also, can she legally demand late fees for prior months rent that were late for a day?

**A: yes, if that was the agreement in your written lease.

yes we are moving-and will have most everything out by the time she comes by-just wanted to know if there was a dishonest (other issues thru out the lease i dont even get into) landlord fee or something. we are current in rent for aug-not paid in sept although we would have paid it until she started this.

Really want to stick something on the LL to pay you money. Sorry, no payday here.

If you sign the lease, than you agree to terms. This is a term of the contract.
How is this dishonest? You didn't have to sign.

Curious, why is that mean old LL trying to kick you out? After all, you paid August rent. Was it because she got tired of being paid late? I think there should be a "tenant fee" or something, for that. WAIT! There is!:rolleyes:

I question the waiver of the notice in your lease. If the court REQUIRES the notice, you cannot legally waive needing that notice. The Court requires the notice for LEGAL reasons (to ensure that you were properly notified of the potential eviction).
