What is the name of your state (only U.S. law)? NY
I've rented a room for a little over two years from the same person, I notified them in September that I would be moving in early to mid February.

I moved the majority of my belongings yesterday, I said I'd be back on Monday to get the rest of my belongings, and to clean, I was told ok to getting my belongings however, they wanted to clean them selves (I had a bag of garbage I did not take out, needed to vacuum, remove a fist tank, desk, shelf) They wanted me to sign a statement saying what I did and did not want.

I said I would do that after I got the rest of my belongings and they agreed it was ok. I received texts from the landlord saying that they had to supervise me moving and that I was not allowed to be there unless they are. I paid my rent until the first.

I have many reasons for moving the major one being they took down a board in the basement I had assumed was to make the basement look better and there was no foundation.

The landlord also texted me that they were filing charges for not giving notice (had a third party give my notice to avoid this being said) and for damages (not cleaning). I had no lease, it was a week to week rental situation, I gave them over 4 months notice, I said I would clean and they refused.

I just want my belongings. I do not want to deal with the games. Am I in the wrong? What should I do?

in Johnson City New York was a house and rented room

Ok , you can try to call the police to assist in retrieving the rest of your belongings .

They may just say it's civil matter .

Since you are Pd. up though in rent ,they just may tell them it's an illegal lockout .

It's up for grabs.

You may very well end up in court and let the court decide any damages .

I would first contact the LL and let him know he/she can not take self help in illegally evicting you .

That you are willing to meet there to get the rest of your belongings and for them to sign a note saying any damages are waived in lue of the remaining months rent and any other monies ( including Sec. deposit ) returned to you within 30 days per law .

If they are unwilling ,call the police to assist you and obtain a report that the LL used self help in evicting by changing the locks for your entry .

If the LL sues you , counter sue for your damages .

If you paid rent (you'll need proof) and they changed the locks, that's considered a "constructive eviction" and is illegal. Call the police to go with you to remove your property and get a police report. Tell your LL you'll see 'em in court.
