I appreciate the advice on the bankruptcy issues. No I dont have to foreclose on the house at all. I have 2 times equity on it which I have been living on. I bought at the right time and even still can sell it tomorrow for 3 times I paid for it and paid off all mortgage I owe and live in my house now mortgage free and not have to work 50-60 hours a week to pay 200 to 300 for other people to live in my house that I earned...believve me...I earned everything the hard way...by working...working ...working... at my age with a disabled husband and 2 teenagers and no I dont get medicaid...pay for it all.....I cant do it all anymore..I am very tired....like I said before I was trying to help them but all they did was taking advantage..I was going to sell it, not rent it......had to move because of husband disability

You sound like a bitter hippocrate. Like before- you bad mouth them for spending, while at the same time you are complaining in here to the world about your financial problem? You are a mess. If you can't afford that rental- why do you have a rental? Hmmm. You sound like a frivolous spender that wants everything and whether you can afford it or not. Catch my drift? Shame on you.

blondie...do you do anything else than criticized? Do you need the name of the lawyers? you can call them...he said:" I have to do some research and I charge $275.00/hour and have to get a retainer of $5000.00 before I start"
The renters paid $2000.00 to the lawyer to do the papers,
its on the court papers and will have to pay trustee's fees of 1853.00.... sorry I guess I lied wasnt 4000.00.... 3853.00 ...sorry
 
Funny, I paid about $300 up front to file my Chapter 13. Most Bankruptcy Attorneys will give a free consultation, where you can get your questions answered.

I wonder if your "friends" know that you are bad-mouthing them on this board? Sounds like you need to talk with someone who can help you let go of your resentment. LOL.

You are getting hassled because most of the posters on this forum are either attorneys or people who have dealt similar issues and have an understanding of the process.

1. $5,000 for an attorney to tell you the same thing you were told at the start of this thread is silly.
2. Needing a couple of hours to research it at $275 an hour is silly.
3. No one gives a hoot about your personal situation and your commentary on your tenants is irrelevant -- regardless of how correct it is.
4. Frankly, their finances are none of your business. All you should care about is getting the rent on time.
5. You said they were month to month tenants and then you said they had a lease until Sept 07. Make up your mind. It changes the answer.

THE WHOLE BLOODY DISCUSSION IS POINTLESS BECAUSE:
1. The tenant assumed the rental obligation.
2. If has little bearing on your selling the property.
3. You have to honor your lease -- if one exists
4. If they stop paying their rent, you evict them. End of story.

My "friends" know what I think about their lavish lifestyle..we discussed it many times.

She blames it on him...he blames it on her...he has the 30000.00 car, I can have my lavish birthday parties....etc".
Plus like I said before nobody's know who they are except me! Florida is a big state with tonnes of Chapter 13. I dont condamn everybody who filed, every cases should be treated individually. What I am saying is I cant afford to help them anymore... and just wanted to know my rights regarding the matter. I am very grateful for all the help I received here. This is a new and interesting site..to say the least.... I certainly didnt come here to fight with everybody....everyone is intitled to an opinion but before you do, I wish you walked in my shoes for a while...

I swear this lawyer called me yesterday from this big firm wanted that money first.
YOu are right, I shouldnt talk about the renters, didnt realized...Sorry!!!
