Hello Everyone!

My lanlord wants to tow our vehicle. He first said that he wanted to tow it because it wasn't registered. It is registered and perfectly legal, it's just that someone had stolen our plate. So we went and got a replacment plate and thought everything would be fine. Well it wasn't... he came knocking on my door and said if I didn't have it towed by Friday he was going to tow it. He also said that if HE had to tow it, we would be evicted. I asked him why it still had to be off of the property considering it was legal and we had plates, and he replyed "It's a piece of junk"! Now, it is an older car and not that pretty, but it does run (we don't drive it that often) and is legal. Does he have the right to still make us get rid of it? And can he evict us if he tows it?

call your city and get a copy of your citys junk /non running car ordinance for vehicles that are on pvt property , and read it . if your lease doesnt address the issue and you can prove the plates and tabs are current then send your LL a written letter saying what you didnt find in your lease and a copy of the local ordinance for junk car parking and last a copy of your rct for current tabs and tell him If he tows a vehicle that has current registration that doesnt meet your citys junk parked car ord . that you will have no choice but to sue him in small claims court . IF your a month to month renter it would be far easier to tell him to flake off and give proper written notice and move out .

Thanks for your advice.
I am month to month, but I don't think it would be easier to just move out and plus I can't afford to move out.
Also, it's not a "junk" car. It does run just fine, it's just not the nicest looking car.
One more thing... If he does end up towing it, can I get evicted?

HomeGuru... No there isn't any more to this story! That's it, plain and simple. That's why I'm so surprised and I want to know if he can do this legally. I have lived here for 4 years, have always payed rent on time, and have had no problems with him (up until now).

Thanks for all your help, but it's now done and over with. It has been settled and everything is alright.

HomeGuru... Please just get a life. Do you think that your criticism is getting you anywhere? And I'm sorry that for some reason you don't believe me, but it was all true. Why would I ask for help and then lie about everything?

You must forgive HG. Although a bit of an *ssh*le from time to time, (s)he generally has good advice. You just have to be an expert mind reader to tell if what is being said is a burn or advice. Glad to here everything is ok.
