Ok i will be as elaborate as i can be on this situation. I was searching the internet to purchase a cheap laptop or a refurbished laptop. I stopped by a website www.electronixindex.com. I saw a laptop for $650. On 12/11/2003 i decided to purchase it and placed the order through their website. I then recieved several consecutive emails. The first was to verify that i was truely interested in purchasing the merchandise. I responded with a yes. The second was to setup a payment. Their options were western union or moneygram. I choose western union. I made the payment at 12/12/2003 of $650, and it cost me $60 to send it western union. So a total of $710. I then sent an email saying that i had made the payment. I recieved another email saying that they had recieved my payment and it would be shipped with in 48 hrs and that i would have it Tuesday or wednesday. It is now 12/22/2003 and i have yet to recieve the merchandise. I have sent an email a day since wednesday 12/17/2003, with my invoice information, payment information, inquiring as to where my merchandise is, and if there is a routing number or tracking information. I have called and left a message 4 times during the business week. I find it a little weird that they were so attentive prior to the sale and since the sale and confirm reciept of my money, they have yet to contact me or respond to my various emails or calls. The business address is in Minneapolis, MN 55417. My question is. Have i been scammed? What is my recourse? How do i go about getting my merchandise or Money back? Is this a Criminal or Civil issue? Basically what should i do? or should i just wait a little longer.

My response:

You have been scammed.

Why do you think they wanted immediate negotiable instruments, rather than a cancellable check, or a credit card?

Next time, you'll remember not to purchase anything off the Internet, and deal with local merchants or local private parties.

So the invoice that they asked me to print of the internet, the email addresses, the active website, the names on the western union tickets, and the names off the emails will help me in no way?

So if i have been scammed what should i do now?

I found their info listed on the better business bureau. I filed a complaint. What exactly is it that they will do in respect to this specific problem?

**A: what did they tell you on their website and when you inquired?

"Have i been scammed?"
*** Probably.

"What is my recourse?"
*** You can try to file a fraud or theft complaint with THEIR police department. You can also consider filing a small claims lawsuit against them in THEIR court.

"How do i go about getting my merchandise or Money back?"
*** See above.

"Is this a Criminal or Civil issue?"
*** See above.

"Basically what should i do?"
*** See above.

One thing that should scare the hell out of you.... according to their site registration, they are BRAND NEW, having just gotten their website last month (13 Nov 2003).

Also of interest. Though they show a Minnesota address, the site registers to a person in NM:
Domain name: ELECTRONIXINDEX.COM
Created on: 2003-11-13
Updated on: 2003-11-13
Expires on: 2004-11-13
Registrant Name: DEBRA INCENDIO
Contact: Debra Incendio
Registrant Address: 1900 Cochita Lane
Registrant City: Las Cruces (NM)
Registrant Postal Code: 88007
Registrant Country: US
Contact Tel: +1 505 5235597

You might try calling her at the above number and see what information she can provide on their activities.
BTW, she is the Controller for a corporation in Las Cruces (Santa Fe Mining Co.)

Thanks for all the responses. I filed a complaint with the better business bureau. The information on the invoice matched that of the listed owner on the better business bureau. I will give that other person a call also. They are in good standing as far as the BBB is concerned. I will also see if i can file criminal and civil suit. i have to get with a local lawyer.
