last minute Subpoena in child custody case! What are my rights?

What is the name of your state? TEXAS
My husband and I received notice at 5:30p.m. we were being Subpoena'd to give testimony at 9:00a.m. the following morning. It is spring break, my husband is self-employed and has to work, and I have two children at home to take care of! Can they do this? The Subpoena is for us to testify for the parents of friends who are trying to get custody of pur friends 3 year old son! I can not imagine why they would subpoena us to testify for them in the first place. Is there a limit on how much notice we are to be given or is less than 24 hours legal? What can they possibly want from us on such short notice and without any prior preporation by their attorney? This is ridiculous!

Short answer: Go. Get a babysitter and Go. Tell the Truth.

Long Story: Look up your state's online requirements of notice of subpoena. Or give a call to the attorney who subpoena' you for the same...along with the reasons why you fear you will not be able to attend.
Contact the courthouse of that county to see if they have childcare services available (Many Do).

If you are a personal friend of a person fighting for custody- your testimony may be extremely relevant.

So, pretend you are your friend and your friend is you and do the right thing.

It's not our friends attorney's subpoena, it's the other sides! This is what I do not understand. It is 8:00a.m., I can not locate information concerning "how much" notice they are required to give for testimony, so I guess I will be on the court house steps in an hour.
