I agree...the Bar is a joke...but

Having seen how the Kentucky bar disciplinary process works I have to agree that Kentucky's is pretty bad. But I would also say Indiana's is as bad if not worse. The problem is the disciplinary process is very, very political. Because of separation of powers, there is no oversight over how the Disciplinary Commission and ultimately the state Supreme Court handle complaints against attorneys. You'll have mild violations pursued aggressively while egregious violations are not pursued at all. Indiana's Commission is truly horribly corrupt. The same Commissioner and same Chief Justice have run the show for probably about 12 straight years now if not longer.

As far as the word "cover-up" goes that offended the Kentucky lawyer, well I could tell you stories of things that have happened in Indiana that have been covered up by our Commissioner and Chief Justice that would curl your toes. It's really a bad situation. Unfortunately that's what always happens when you grant one (or in this case two) person absolute power with no oversight such as is the case with the disciplinary process. The saying that absolute power corrupts absolutely, is very true

Fortunately I've never been on the receiving end of the discipline. But I have seen things that are highly unethical and I find very offensive.

Complaints stay on their record for a year in Florida (probably same in most states). In Florida, however, legal malpractice attorneys are starting to sue incompetent attorneys. In fact, one LMA said, "Sure, if there is money in it, I'll sue an attorney."

My experience with the State Bar was a joke even though he was caught red-handed. However, smart people call the Bar to see if complaints have been filed and if so, they find another attorney. The doctors club is a good clue on how it works. The lawyers club works the same way.

Also, you might notice a lot of people are representing themselves these days since they don't trust lawyers or can't afford them.

I have know a lawyer who told me that she had a couple of recent bar complaints, but when you call to check, they say she is fine. kentucky won't tell you if they had complaints. they only tell if they have been disciplined.
That doesn't seem right. :(
