Lawyer in an accident??

What is the name of your state? CA

If my lawyer got into an accident, what would happen to my eviction case? Is he suppose to appoint some other lawyer to take over?

No. I just haven't heard from him in a while. He usually returns my calls. I haven't heard from him in about a month. I call and call and I all I get is his VM or answering machine.

My response:

We do the same thing in my office when annoying clients keep calling. I guess they think that all of us are dead.

Get a new attorney.

Okay so what happens to the $400 that I paid him to do the eviction?
Well, I don't think I am an annoying client. When he and I talk on the phone, we talk for hours.

My response:

Joe, your $400.00 is gone, having been used up on those lengthy phone conversations. He's undoubtedly not calling you back because there's no more money in your account.

Send another $400.00, and your calls will be answered and returned. Until then, you're not paying for his monthly phone account, like his other clients. Someone's got to pay for the phone, the lights, the electricity, the paper, etc., etc., etc., and you're not doing it.

**A: he never started the eviction since when you talked to him for hours the $400 was used up. You owe him more money. Didn't you know that he charges by the hour and the longer you talk to him the more he bills you?

I don't believe that. Also he did start the eviction. Anyways, can someone answer my question? If he was in an accident is he suppose to appoint the case to another lawyer?

How about he just doesn't want to take your calls, or he's on vacation, or he's in jail, or he's in a lengthy trial, or, or, or, or ?

Okay, I am looking for just the worst case scenario. Yes maybe he is in jail or maybe he is dead. So can I get my answer...Please!

If he is in an accident, dead or in jail or some situation beyond his control, and can't perform his duties, is he suppose to appoint another lawyer to my case or at least notify me?
