I work as an "Agent" for over 100+ medical facilities in administering these facilities unpaid medical bills for collection by acting as a go between them and the attorneys I hire on their behalf to litigate the cases.
As a paralegal, I have worked very hard to build up my business over the last four (4) years and have over 100+ clients.
The initial lawyers I hired for my clients were not doing a good job and not properly litigating the cases. I decided to move my clients files to a new law firm who could process them properly. I didn't move the files to the new law firm until I spent about a year in talks with them and was convinced they can do the job and would cooperate with me in doing my job as the clients legal agent. There are 3,000 files totaling over $3 Million.
Unfortunately, when this new firm took possession of the files, they would not send me "status reports" on my clients' cases. I'm aware that many settlements have come in on my files and these attorneys are sitting on thousands of dollars of my money (I receive 20-25% paid directly from the clients as compensation). The Clients keep calling me and complaining about the status of their cases. Clients have now started to call the attorneys directly and the attorneys are giving them the status reports. It seems that these attorneys are about to send my clients retainer agreements.
I have an "Agency" agreement with every client that not only gives me the legal right to process these files but to also "enter into contract" with a law firm to have these cases litigated. Unfortunately, due to this law firms actions, my company, I worked to build for the last 4 years, is being destroyed.
It's clear what they are trying to do. Steal my clients and files. I understand there are legal theories based on "Interference Of Contract" that I can establish a "cause of action" under. The facts for this cause of action would be based on their deliberate actions in failing to submit "status reports" to my company on behalf of my clients as their legal agent. And their deliberate action in sending my clients a "retainer agreement" when they are very much aware that I have the legal right to enter into such an agreement on behalf of my clients. Their actions are directly damaging my relationship with my clients and damaging my business.
I understand I can also go into Supreme court and file an order to show cause to force these attorneys to release such status reports. If the attorneys pocketed my fees from my clients, there is a cause of action created here for "conversion". Because the acts were intentional, there would be punitive damages that could treble any award against them.
Can anyone give me a "clear" legal understanding of this situation and what would be the best route to take? Can you refer an attorney in New York to me. It's very devestating to work so hard for so long than have someone take it all from you like this.
