Dear LdiJ,

You gave me some good information, again thanks. We are in court in June on $$$ issues only. At least I am hoping that is all. After that I was going to look into opening a case to try to get visitation the way it was court ordered. 60/40. My attorney had me count the # of days I have the child and one year it is 54% and one year it is 57% depending on who gets her Christmas that year. How hard is it to get to the 60/40? I have 100% physical custody, 60 % visitation, she goes to school in my city, and has been in the same school 7 years now (she is 12 years old)
Are you an OC attorney? Do you deal with child visitation issues?

While your ex may owe back child support and you may want to place a lein on your former marital property and are currently trying to get more parenting time to raise his child support payments, remember that you signed an agreement when he bought you out of the marital residence. You better go back and read that agreement very very, closely. You must also understand the consequences of placing a lein against the property IF you are able to. Also understand that OC may be able to place a lein while you may not. Unless there are significant changes, you will most likely have to pay your own attorney. OC has online searches available to check taxable assets.

BTW, Ldij is an accountant in Indiana, not an attorney, Did you Mean IAAL, he is an attorney in LA and very familiar with California family law.

And you are correct, when we signed on the dotted line, must live by it. And since I was awarded 60% and the current visitation falls short, do I have a right to ask for some additional time with my daughter because of this? To get me to 60%?
I am only involved in a case to attempt to get dads child support reduced right now, thats all. I am not trying to place a lien.
